Terms and Conditions

1. General
- 1.1. Information on how to enter and on the prizes form part of these terms and conditions. Participation in this competition is deemed acceptance of these terms and conditions. If you do not accept these conditions, you must not enter.
- 1.2. If under 18 years of age, express permission of a parent/guardian is required before entering this competition.
- 1.3. The Promoter is Waalitj Foundation Limited (ABN 70 701 664 556) of Mineral Resources Park, 42 Bishopsgate Street, Lathlain, WA, 6100. (Promoter or Waalitj).
2. Entry
- 2.1.The competition commences at 9am AWST on Wednesday June 4, 2025, and closes at 4pm AWST on Thursday 19 June, 2025 (Promotion Period).
- 2.2. During the Promotion Period, entry is open to individuals aged between 15 and 25 years of age who:
- reside in Western Australia; and
- are participants in the Waalitj Foundation Youth Program in Laverton, Western Australia
- (Eligible Entrant).
- 2.3. Failure to comply with any of the above requirements in clause 2.2 will automatically render an Entry to be invalid.
- 2.4. Incomplete, indecipherable or illegible entries will be deemed invalid.
- 2.5. Employees and their immediate families, of the Promoter, related companies of the Promoter or agencies associated with this competition are ineligible to enter.
- 2.6. Entries must be provided to the Waalitj Foundation during the Promotion Period either via email to meleanet@wf.org.au or to the Waalitj Foundation Laverton Office located at 18 Augusta Street, Laverton 6440 (Office). Entries are deemed to be received at the time of receipt either by email or at the Office. The Promoter is not responsible for any delay or failure of transmission of any Entry.
- 2.7. Any costs associated with submitting an entry including without limitation the creation of the design is the responsibility of the entrant. The Waalitj Foundation will not reimburse an entrant for any cost incurred in entering this competition.
- 2.8. There is a limit of one Entry per person.
- 2.9. The Promoter reserves the right, at any time, to verify the validity of Entries and entrants and to disqualify any entrant who manipulates, or attempts to manipulate, the system.
3. Judging
- 3.1. The competition is a game of skill, and chance plays no part.
- 3.2. The Eligible Entrant who submits the best Entry (as determined by the judges) will win the Prize (Winner).
- 3.3 Judging will take place at the Waalitj Foundation Laverton Office on the 20th June 2025 at 10am AWST;
- 3.4. Entries will be judged by a panel of judges appointed by the Promoter.
- 3.5. All entries will be judged individually on their merits based on design, creativity and appropriateness.
- 3.6. The Winner will be notified by phone and/or email by the Promoter on Tuesday June 24, 2025.
- 3.7. The Promoter reserves the right to select reserve entries which they determine to be the next best, and record them in order of merit, in case of an invalid entry or ineligible entrant being selected. For the avoidance of doubt, only one Prize will be awarded.
- 3.8. All reasonable attempts will be made to contact the Winner. If the Winner cannot be contacted 3 Business Days after the applicable judging date and time, the Prize will be forfeited and the Promoter will begin the process of contacting the reserve winners who will then become the Winner.
- 3.9. Once one Winner has been selected and contacted, no further prizes will be awarded.
- 3.10. The judges’ decision is final, and the Promoter will not enter into correspondence regarding the result.
4. Prize
- 4.1. The Winner will receive the prize, which consists of the following elements:
- A 512 GB Apple I-Pad; and
- The opportunity for their design to be featured on the Waalitj Foundation Youth Program shirt for the next 12 months,
- (Prize).
- 4.2. The total prize value for this competition is $1222.00 (inc GST).
- 4.3. If the Winner is under 18, the Prize may be awarded to the parent or legal guardian who consented to the Eligible Entrant registering in the competition on behalf of that Eligible Entrant, at the sole discretion of the Promoter.
5. Risk, Liability and Conduct
- 5.1. The Promoter reserves the right to request that the Winner provide proof of age and identity prior to awarding the Prize. Identification considered suitable for verification is at the discretion of the Promoter. The Winner will be required to sign an agreement with the Promoter which will include, without limitation, a legal release and indemnity form and a Licence Agreement granting the Waalitj Foundation the ability to utilise the artwork. Failure to provide such a licence to the Waalitj Foundation may result in the forfeiture of the Prize at the discretion of the Waalitj Foundation.
- 5.2. The Winner must acknowledge and agree that the Waalitj Foundation may be required to adapt the design to allow for its use on the Youth Program apparel.
- 5.3. The Winner is required to comply with any and all reasonable requirements and instructions of the Promoter. Any failure by the Winner, in the reasonable opinion of the Promoter to comply with its reasonable requirements or instructions may result in forfeiture by the Winner of any part or all of the Prize.
- 5.4. The Promoter is not responsible for any costs incurred by the Winner in creating the design or in collecting or using the Prize (or any portion of the Prize) including without limitation any damage incurred to the Prize after it has been awarded.
- 5.5. The Promoter and its associated agencies and companies (and their respective directors, officers, employees, contractors and agents) will not be liable for any loss (including without limitation, indirect, special or consequential loss or loss of profits), expense, claim, action, demand, liability, damage, personal injury or death whatsoever, which is suffered or sustained by any person or entity (without limitation), (whether or not arising from any person’s negligence or wilful misconduct) in connection with this competition or accepting or using any Prize (or part of the Prize), except for any liability which cannot be excluded by law (in which case that liability is limited to the maximum extent permissible by law).
- 5.6. If for any reason this competition is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the competition.
- 5.7. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
6. Your Information
- 6.1. The Promoter collects personal information about all entrants, whether Eligible Entrants or not, to enable them to participate in this competition, and for any other matter connected to or incidental to this purpose, and the Promoter may disclose the personal information to third parties including contractors and agents, suppliers and service providers to assist in conducting this competition or providing the Prize. By registering their interest, entrants agree to the Promoter using and disclosing their personal information for these purposes. If the entrant does not provide their personal information as requested, they may be ineligible to enter the competition.
- 6.2. The Winner consents to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Competition, the winning design or the Waalitj Foundation, or for any other related purpose at the Promoter’s sole discretion.
- 6.3. All personal information provided will be stored, used and may be disclosed by the Waalitj Foundation in accordance with the Privacy Policy available at https://www.wf.org.au/privacy-policy/
